Community constitution guidance issued

GUIDANCE has been issued, to help communities constitute themselves as companies limited by guarantee.

The Scottish Government has issued a template for communities to potentially adopt, not least when seeking to acquire land.

Says the Scottish Government, here: “This model Company Limited by Guarantee template has been created to enable a community to form a Company Limited by Guarantee, for the purposes of registering an interest in land and exercising the right to buy land under Part 2 and Part 3A of the Land Reform (Scotland) Act 2003 and Part 5 of the Land Reform (Scotland) Act 2016.”

It is made clear – again – that the government’s definition of ‘community’ is ‘by geography’, rather than ‘by interest’ – such as a Cohousing group recruited from far and wide.
